Overview

Be Your Own Coach NLP Immersive is an 8-month NLP certification course with soul, plus 6 months of post-course mentoring (the "BYOC NLP Course"), for coaches who want to develop a new skill and folks who desire to understand how to better communicate for leadership and change.

Master the art of upgrading your mindset of self, your ability to lead and influence with integrity and develop a deep understanding of others so you can overcome any hurdle and model excellence step by step, for yourself and others - for good.

This Terms and Conditions (the "Agreement") is a legally binding contract between you (the "Participant") and Hayley Carr International Pty Ltd ABN 34 623 378 807 (the "Facilitator", "Hayley Carr International") and applies to the purchase of the BYOC NLP Course referred to below.

Please read this Agreement carefully, seek independent legal advice or contact hola@hayleycarr.tv if you would like to discuss any aspect of this Agreement.

You are deemed to have accepted the terms contained in this Agreement upon payment of the BYOC NLP Course fees.

This Package includes:

  • 16 training modules
  • Over 100 high-quality training videos and audio
  • 26 x 2-hour live coaching, training & supervised practise sessions
  • Breakthrough Week: five focused daily sessions of partner practice with trainer mentoring
  • Module assessments, with coaching support to achieve 100% on your test
  • A 700-page hardcover NLP processes handbook, plus a digital (PDF) copy
  • An audio self-coaching library
  • Digital versions of all BYOC tools
  • An exclusive Kajabi Community group for peer support and extra questions
  • Lifetime access to all your online content and updates (for the life of the BYOC program)
  • 6 months of post-course mentoring
  • Upon Graduation, admission to the BYOC Alumni group and subsequent support trainings
  • The option to re-attend a live cohort at a discounted rate

Our coaching will commence following the acceptance of this agreement, the receipt of the deposit or first payment and the completion of any extra questionnaires.

We will be meeting on Zoom as our meeting source. You can call in from anywhere. It is preferred you can have your video on so we can practise using our visual calibration skills as coach and client.

Coaching Communication

You understand and agree that:

  1. All ongoing communication will take place on weekdays between regular work hours via Kajabi Communities.
  2. Hayley Carr will respond to your messages via Kajabi Communities in due time (usually within two business days).

All currencies are in AUD.

Fees & Payments

All payments will be automatically debited from your account every 31 days, and will be taken through our website order form (which has been sent to you via email) and will be taken care of automatically once you have entered your details.

  1. The full fee for the BYOC NLP Course is $7,500 AUD in full.
  2. All fees are in AUD, USD payment form amounts reflect the AUD price.
  3. Payment plan must be complete within the period of your chosen payment plan.

You understand and agree:

  1. Your commitment to your success and completion of the BYOC NLP Course is required to gain maximum results from the BYOC NLP Course.
  2. Hayley Carr International offers a 30-day cooling-off period where you may withdraw from this Agreement and the coaching program with a full refund less a $150 administration fee. Where a Participant cancels after the 30-day cooling-off period, the BYOC NLP Course fees are non-refundable.
  3. You must exercise your right under the cooling-off period by emailing your request to hola@hayleycarr.tv.

Payment Plan

  1. A payment plan is available, and payment is via direct debit from a nominated credit card each month for the period of your chosen payment plan.
  2. Payments are required to be completed online by Debit, Credit Card, and via our payment platform.
  3. If a payment fails, our system will attempt to process payment again within 24 hours and continue attempting until payment is successful.

Withdrawal

  1. There is no refund whatsoever for a change of mind and withdrawal from the program.
  2. You remain liable for the remainder of the Coaching fee regardless of whether you paid in full or by payment plan for all services rendered. (Please see the refund policy for reasons other than a change of mind below).

Late payments

  1. A five-day grace period is applied to late payments.
  2. Payments overdue by more than five business days will incur a late payment fee of 8.96% per annum (calculated daily from the date due).
  3. Payment responsibility and refund request management are dealt with below under paragraph marked Payment Terms and Refund Management.

Variation

  1. Hayley Carr International reserves the right to vary fees at any time.
  2. Changes in fees will not affect you and will only apply to new clients.

1. Term

  1. This Agreement will begin upon payment of the BYOC NLP Course fees.
  2. It will apply for the duration of the BYOC NLP Course and completion of any payment plan beyond the length of the BYOC NLP Course.

2. Be Your Own Coach NLP Immersive

The Be Your Own Coach NLP Immersive - 8 months, plus 6 months of post-course mentoring - $7,500 AUD paid in full. 10-month ($8,500 AUD) and 18-month ($9,000 AUD) payment plans are also available - see paragraph 3 below.

Online sessions and access to modules

  1. All sessions and practice calls are delivered online via our website or Zoom.
  2. All modules are self-paced for self-study and can be completed on your own time.

Assessments and Protocols

  1. At the end of every module, there will be a test that the Participant can take with unlimited attempts and support from a coach to achieve 100%.

Resubmission protocol

  1. Participants may reattempt the test and reattend practice sessions if required.
  2. There is no refund for failure to complete or pass the BYOC NLP Course. (Please see Refund Policy Clause 4 below).

Qualifications

  1. Participants will receive a digital combined NLP Practitioner + Master Practitioner Certificate once all requirements are completed: the core 8-month training, all module assessments, Breakthrough Week, and payment of the program balance in full.
  2. Certificates are issued after final payment. Participants on a payment plan who meet the graduation requirements before their plan finishes may pay the remaining balance early to receive their certificate.

3. Fees and Payment

  1. The fee for the BYOC NLP Course is as advertised on the website and outlined above.

Payment Plan

  1. Payment plans are available to all Participants at checkout, as outlined in the fee table above.

General

  1. All fees are in AUS dollars.
  2. GST (Australian Good and Services Tax) is included in all purchases by Australian residents.
  3. Payment is accepted by Stripe and PayPal.

Promotions

  1. From time to time, Hayley Carr International may offer promotional programs, including programs to Australian residents in Australian Dollars, to which these terms and conditions apply.

Late payments

  1. You are responsible for ensuring that payments are made on time. If a payment fails, our system will attempt to process payment again within 24 hours and continue attempting until payment is successful.
  2. Hayley Carr International reserves the right to cease BYOC NLP Course access until the due fees are paid in full.
  3. If an account is beyond 30-days overdue, Hayley Carr International reserves the right to turn the account to third-party collections to collect your debt and related fees.
  4. This Agreement will be terminated, and no further access to the BYOC NLP Course will be provided.

Variation

  1. Hayley Carr International reserves the right to vary fees at any time.
  2. Changes in fees will not affect you and will only apply to a new BYOC NLP Course delivery round.

4. Refund Policy

You understand and agree:

  1. Hayley Carr International offers a 30-day cooling-off period during which you may withdraw from this Agreement and the BYOC NLP Course with a full refund, less a $150 administration fee.
  2. Where a Participant cancels after the 30-day cooling-off period, the BYOC NLP Course fees are non-refundable.
  3. No refunds are offered for a change of mind.
  4. You remain liable for the remainder of the BYOC NLP Course fee regardless of whether you paid in full or by payment plan. (Please see Refund Management for reasons other than a change of mind below).

Refund Management

You understand and agree:

  1. Your commitment to your success and completion of the BYOC NLP Course is required to gain maximum results from the BYOC NLP Course.
  2. Refund requests for the BYOC NLP Course will be managed according to our obligations and your rights as a consumer under Australian Consumer Law.
  3. Refund requests will be considered on a case-by-case basis and are not guaranteed.
  4. Where your payment method is via a payment plan, costs will be calculated and deducted from the total fees owing to Hayley Carr International.
  5. You will remain liable for the balance for payment owed to Hayley Carr International.
  6. Failure to pay at any time is a breach of this Agreement, and we are entitled to seek legal relief and remedy for this breach and recover the debt owed by you.
  7. Outstanding accounts and costs for collection will be referred to a third party for debt collection.

5. Day-to-day Communication

You understand and agree:

  1. Day-to-day communication for the duration of the BYOC NLP Course is via the Kajabi Communities Support Group.
  2. The Kajabi Communities Group helps build connections and facilitate group learning, peer support, and education.
  3. Unless your communication is personal or confidential, you are requested to post all questions, comments, and observations to the group chat (not privately) in the Kajabi Communities Group.
  4. With any private matters such as queries regarding the BYOC NLP Course, accounts, or personal issues, please email hola@hayleycarr.tv.
  5. Emails are responded to within 48 hours during business hours, Monday to Friday.
  6. The Facilitator will respond to group questions within 48 hours on business days only.

6. Participant Expectations

  1. Participants are required to:
    • complete all modules
    • watch replays of videos
    • complete homework
    • complete assessments
    • learn and practice new skills
    • conduct practice sessions on fellow Participants
    • be self-disciplined and self-motivated with study and skills practice
    • show up to the practise calls
  2. Your commitment includes but is not limited to:
    • completing the entire BYOC NLP Course you have purchased with full participation
    • attending all live calls or viewing replays
    • being present and engaged in the private Kajabi Communities Support Group
    • being committed to achieving your defined outcomes
    • being open-minded and curious
    • having the desire to integrate the teachings of the BYOC NLP Course within your life, business, and career
    • being supportive of others in the BYOC NLP Course

Kajabi Communities Group

  1. The private Kajabi Communities Group is by invitation only for Participants.
  2. The sole purpose of the Kajabi Communities Group is to provide a private forum for Participants to ask questions.
  3. You agree to abide by the Kajabi Communities Group rules of conduct, privacy and confidentiality of group discussions, member details and posts relating to their personal stories and businesses.
  4. You are prohibited from promoting your business, other Kajabi Communities or social media groups and similar NLP Courses to that of the BYOC NLP Course under this Agreement in the Kajabi Communities Group or by private message to other group Participants.
  5. Toxic, abusive and disrespectful conduct will result in removal from the Kajabi Communities Group.
  6. Sharing posts from the Kajabi Communities Group, including images, is strictly prohibited. This conduct will result in immediate removal from the group.
  7. You will respect the confidentiality of each Participant in all group coaching calls.
  8. You will not discuss other Participants or their personal stories in either an individual or professional context, outside the group, for any reason whatsoever without the express written permission of the Participant.

Technology issues

  1. Hayley Carr International shall not be held responsible if there are any problems with the website or if the host or network should go down due to circumstances beyond our control.
  2. When it is within our control, we will do our best to get the system back up as soon as possible.
  3. Hayley Carr International shall not be liable to you or any other party because of viruses or malware that may infect your or any other party's electronic equipment.
  4. You agree that you:
    1. will not use any robot, spider or other devices, process or means to access the BYOC NLP Course;
    2. will not compromise or circumvent the security controls of the BYOC NLP Course or otherwise gain unauthorised access to the BYOC NLP Course;
    3. will not attempt to interfere with the proper working of the BYOC NLP Course.

BYOC NLP Course Portal

  1. You will be required to register your details to create a password to access the BYOC NLP Course content in the BYOC NLP Course Portal on Kajabi.
  2. Your responsibility is to ensure the details you provide are correct and current.

Password security

  1. You are solely responsible for the protection and confidentiality of any password that may be issued to you or subscribed by you from time to time.
  2. You will not share your password with any other person.
  3. You will notify us immediately if your password is lost or becomes known to anyone else.
  4. You are solely responsible for accessing and using this Site via your password, whether such access or use is by you or any other person.
  5. The personal information you provide to the BYOC NLP Course will be managed according to our Privacy Policy.

7. Confidentiality

  1. All information shared with the Facilitator during coaching sessions is confidential and will not be shared with a third party unless required by law.
  2. Personal and business information provided by you is managed by our Privacy Policy.

8. Intellectual Property and Copyright

  1. All material, including but not limited to videos, call recordings, resource downloads, and templates available in the BYOC NLP Course and within any BYOC NLP Course created by Hayley Carr International, are the property of Hayley Carr International and her affiliates or licensors. Accordingly, they are protected by copyright, trademark, and other intellectual property laws.
  2. As a Participant, you are always bound to ensure that you do not breach our intellectual property rights for any reason.
  3. You may not use any of the materials available in the BYOC NLP Course or any teaching platform or in a manner that infringes any of our rights or has not been expressly authorised by us.
  4. All material, including but not limited to videos, call recordings, resource downloads, and templates available in the BYOC NLP Course and within any BYOC NLP Course created by Hayley Carr International, is provided solely for your personal use.
  5. Use of materials for any other commercial purpose is prohibited without the express written permission of Hayley Carr International.
  6. You may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material the BYOC NLP Course or related BYOC NLP Courses without the express permission of Hayley Carr International. You may request such permission by emailing hola@hayleycarr.tv.

9. Disclaimer

You understand and agree:

General

  1. You have engaged Hayley Carr International's services and purchased the BYOC NLP Course at your own risk.
  2. The advice and information offered in the BYOC NLP Course are based exclusively on Hayley Carr's training, experiences and approach to NLP and NLP teaching.

Non-affiliation with NLPAA

  1. Hayley Carr International, including the BYOC NLP Course, is not affiliated with the Neuro-Linguistic Programming Association of Australia Inc (NLPAA) board.
  2. The BYOC NLP Course is developed independently to meet the needs of NLP practitioners and students to obtain an in-depth and immersive NLP learning experience.
  3. Unlike other NLP courses, including that by the NLPAA, the BYOC NLP Course is an 8-month immersive program, plus 6 months of post-course mentoring, based on Hayley Carr's own professional and personal experience and NLP training.
  4. The course material is based on Hayley Carr's own professional and personal success using these methods; however, HCI makes no promises for the results of others using these methods.
  5. NLP is an interpretive modality, and variances in interpretation may occur as a result. In creating this program, Hayley Carr International endeavours to provide accurate, relevant and quality information.
  6. All content, resources, and coaching are solely for personal use and information.
  7. Hayley Carr International does not offer any representations, warranties, or guarantees, verbally or in writing, regarding your results from the BYOC NLP Course.
  8. Hayley Carr International cannot and does not guarantee your ability to get results or improve your health or otherwise with our coaching, tools, ideas, information, or strategies.
  9. Results are dependent on various factors, including but not limited to your commitment, personal ability, and dedication, and in no way dependent on any information or strategy provided to you by Hayley Carr International.

Earnings disclaimer

  1. Hayley Carr International cannot and does not make any guarantees about your ability to get results or earn any money from mentoring, advice, ideas, information, or strategies provided in any BYOC NLP Course or from your decision to develop a business by offering the skills and information you have learned.
  2. You acknowledge that there is an inherent risk in any business enterprise or activity, and there is no guarantee that you will earn any money as a result of the purchase of any BYOC NLP Course.
  3. Nothing in the disclaimer above will limit or exclude any liability that may not be limited or excluded by applicable law.

10. Limitation of Liability

You understand and agree:

  1. Liability for the services provided by Hayley Carr International is governed solely by the Australian Consumer Law and these Terms and Conditions.
  2. Nothing in these Terms removes your Statutory Rights as a consumer under Australian Consumer Law.
  3. To the extent permitted by law,
    1. Hayley Carr International excludes all express or implied representations, conditions, guarantees, warranties, and terms relating to any Services except those in this Agreement.
    2. Hayley Carr International denies any liability in contract, tort (including negligence), or otherwise for any direct, indirect, special, incidental, or consequential costs, losses, claims, damages, expenses or proceedings incurred or suffered by you arising directly or indirectly out of or in connection with its services, including but not limited to any loss, damage or expense arising from any defect, error, imperfection, fault, mistake or inaccuracy with the information or advice provided by Hayley Carr International.
  4. Hayley Carr International guarantees that all services are supplied to you with due care, skill, and fit for the advertised services.
  5. To the extent that Hayley Carr International is unable to exclude liability; total liability for loss or damage you suffer or incur from services by Hayley Carr International is limited to re-supplying the Services to you or, at our option, refunding to you the amount you have paid for the Services to which your claim relates.

11. Dispute Resolution

You understand and agree:

  1. You will contact Hayley Carr International immediately with any concerns for quick and effective resolution through friendly consultation.
  2. In the event of a dispute, you agree to the following Dispute Resolution Procedure:
    1. You must advise Hayley Carr International in writing of the nature of the dispute, the outcome you seek and what actions you believe will settle the dispute.
    2. In good faith, you agree to meet with a key representative of Hayley Carr International in person or via Zoom or Skype to seek to resolve the dispute by Agreement and compromise.
    3. If an agreement cannot resolve the dispute, any party may refer the dispute for mediation to the Law Society of New South Wales (NSW).
    4. Both parties must attend the mediation provided by the Law Society of NSW in good faith to seek to resolve the dispute.
  3. Litigation via the court process may only be considered after a genuine attempt at mediation brought by either party is unsuccessful.
  4. Confidentiality is paramount to both parties' personal and professional reputations and standing in their business and community.
  5. At no time will any communications or discussions be made public, including but not limited to any social media platforms or websites of either party.
  6. Any public discussion or comments about either party will be considered defamatory, harmful or otherwise damaging. They will be the subject of compensation in any mediation or litigation claim.

12. Governing Law

You understand and agree:

  1. The Terms and Conditions of this Agreement are governed and construed under the laws of New South Wales.
  2. Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of New South Wales.
Thank you for reading this Agreement. You accept the Terms and Conditions in this Agreement by proceeding with your payment.
